Demand Letter

Apparantley the Wilderness Club in Eureka Montana
is upset that I am telling you about them.

They have sent me a demand letter
to stop talking about them.

Blogs are the news these days.

There are blogs on just about everything.

I will let you know everything that happens along the way and update you daily on what the Wilderness Club is up to. They are really mad that My websites come up higher in the search engines than their websites do, so they have hired an attorney to handle me. I hope this case will be a benefit to Intellectual and Trademark law for all of us. My goal for this site was to inform you about the wilderness club golf resort being built in the Eureka Montana area; but they are trying to stop me from this.

The Wilderness Club wants to push around the locals, give us menial jobs, use up our water, cut down all their trees and plant shrubs, ruin our highways with hideous billboards, and they want only ONE real estate broker in charge of all the golf course sales here. All this and they claim to be a benefit for our town. Exclusivity is no benefit for anyone. Read their website, you will have to search hard to find it.

They talk about boating access they DO NOT have, they talk about local shows and fine dining and there is NONE. They have promoted Lake Koocanusa and our daylight hours as if they own it. Folks, Lake Koocanusa is a reservoir.

Today as with most days, huge amounts of dust blows up off of the lake because most of the year the water is way down. Its not a REAL LAKE FOLKS. I will get you a video of how much dust is stirred up every day to let you know what your paying for to live in a giant dust storm. And all you folks who email me about Rexford, you seem to think it is a dreamy little place to live. Rexford is great, I grew up there. I grew up on the "Reservoir" The Wilderness Club Subdivision, gated, private golf cours will take the water from Rexford and one day it will not be this great little town.

Order a packet from their website and than email me. I will tell you what is HYPE and what is true. You WILL travel 1 hour over icy roads for restaurants and SHOWS.

You will be driven to a public access for your boats to launch. And most of the year the water is to low to launch a boat. In the high season the public boat docks are packed. Last summer the Tobacco Plains boat ramp was filled with swimmers, carloads of people partying, garbage,
and lots of speed boats and funseekers. Coming Soon - I will get you videos of the boat launch
area you will HAVE to use. You will Line up, there is only one boat launched at a time.

The Wilderness Club Claims

They Claim I am using their "good" name to benefit my real estate business. We are number one in searches for Northwest Montana, we are a Northwest Montana Internet Marketing Company, I DO NOT need to use their GOOD NAME, they think they have, to get real estate business. The POINT of the website was to provide information on the Wilderness Club Subdivision, it was not negative in any way. But because the Wilderness Club is afraid I am getting Web traffic that they should be getting but don't want to pay for as other working Montana folks do, they want to SHUT MY voice down. With over 2 million website with the words wilderness club on it, they are GUNNING for me.

I had kept this BLOG positive, I even spoke of one neighbor who had been treated nicely by the Wilderness Club and they are demanding that I stop blogging about them. I now intend to explore the dark side of the Wilderness Club Subdivision.

The Wilderness Club offers, supposedly, a referral fee to agents who send them clients or leads. I am not so niave as to actually believe this, however, if it were true why would they not want other agents to get clients and send them to the wilderness club. They handle all of their own sales and pretend that other offices and local agents are included. Later in this post I will show you where I attempted to send them leads and a nice man at the Wilderness Club office in Whitefish assisted me, but my leads supposedly fisled OUT.

I believe this, it happens often, and he clarified how the LEAD went.
Weeks later the office of the local represention of the wilderness club,
the Office that SOLD them the property the resort is being built on, this office
called me and asked me about the gentlemen in Whitefish, they asked they I send them
ALL coorespondence with this gentleman, I was also asked to send them leads instead
of sending them to Whitefish, I told them I would if they offered the same deal, I faxed
them the Referral form that the Whitefish Wilderness Club office sent me and after
this I heard nothing until the Demand Letter.

After this I was TOLD that the request for the emails was to DEFEND
me for using the mark in good faith. WHAT ? I do not need defended,
I was doing NOTHING wrong. I was than told that the Wilderness Club was
pissed about my websites. WHY ?

It was than suggested that the Wilderness Club had made me a HUGE
offer and I rejected it - UNTRUE...

My Website Ranking

The Wilderness Club is upset because my websites rank higher in the search engines than theirs do. They are mad that SPIKER communication who own their domain names are not doing A GOOD JOB AT MARKETING THEM, and so they are taking it out on me. Don't punish me because I get Internet Marketing. The Wilderness Club claims to be upset at the use of "their" mark but they do not
even own their own domain names for their websites.

Now also included in the "demand Letter" from the Wilderness Club is the registration of their "mark" they registered it in Feb. 28 - 2007 and they claim usage as of March 15th 2006. Convenient, they must have looked in the whois database and saw that the domain name this site is on was registered on March 30th of 2006. Also, My Website was registered and used before "their" "mark" was
registered with the state of Montana - yet they want their registered "mark" to
serve as some sort of proof that they can tell me to STOP talking positively
about them. Again, My Website was to report the progress on the Wilderness Club

This could go all the way to the Montana Supreme Court and/or the courts that have juristication over domain names and intellectual property on the Internet which I believe is in Virginia. I will let you folks know what happens.

All I was doing was talking about the Wilderness Club, I was talking positively even though some local folks have negative things to say about the Wilderness Club. All I was doing was reporting the progress and they send me a demand letter from an attorney. WHY ?

I am collecting DATA on the aquifer the Wilderness Club
preformed their tests in. Rumour has it that the tested the wrong aquifer.

Some Wilderness Club media talks about "Old Growth Forest"
there are NO old growth forests on the property,
and if there was, they have logged the land
for the GREENS and the trees left, are small and quite
a few were burned while burning dead grass under them.

that are upstream in the aquifer from their wells

the water YOU drink when you camp at Lake Koocanusa Rexford Bench,
and all those that are below. Unless the Wilderness Club
plans to use ALL NATURAL ways to make sure the local WEEDS
and native plants do not "mess up the greens".

Tidbits - Truth in Media

Glacier National Park
is WAY more
than an Hour away.

I have a Wilderness Club Booklet that
says it borders the Ten Lakes Scenic Area,
and in this same book it says it is 36 miles away.
Crazy, False Media to Lure you to their Resort.

This handout says that the Ten Lakes Scenic Area
is a Designated Wilderness, this is a LIE..
It is a proposed Wilderness and may NEVER
actually be a Wilderness because local folks cannot
agree on its land use, with snowmobiles, skiers and such.

They say Glacier Park is right next door...
WHAT ? It is 2 hours away.

They claim that Lake Koocanusa is at their doorstep.
It is not at the doorstep, their property borders Forest Service.
the Wilderness Club does not Run the Forest Service Here.
you would have to walk through Forest Service and down embankments
to get to the water and thats only part of the year when the water is high.
